USA Today is reporting Brandon Jacobs will file a grievance against the 49ers to get reinstated on the team or to to get released.

The 49ers suspended Jacobs Monday for the rest of the season, which means he would lose …

Clearly Jacobs recognizes his time on the team is done. Matt Barrows (not this article) speculates that Jacobs is not being released to keep him from playing on the Giants or one of the other playoff contenders that the 49ers will face on their remaining schedules.
